Justice Department settles immigration-discrimination case with recruiting firm
The Justice Department settled with New Jersey-based IT recruiting firm Infosoft Solutions for $25,500, having claimed that the firm discriminated in how it advertised open jobs.
The Justice Department claimed that, between July and August 2021, Infosoft Solutions, operating as KForce Tech LLC, posted at least six ads for open positions – but only sought applicants in need of immigration sponsorship or who already had a temporary work visa.
In one instance, they specifically narrowed the criteria to people from India.
In doing so, Infosoft Solutions deterred workers who did not need sponsorship to work in the U.S., including American citizens, legal permanent residents, resident refugees, and asylum seekers, from applying and being fairly considered for employment.
Under the terms of the settlement, Infosoft will also have to retrain recruiters on requirements established by the Immigration and Nationality Act, revise company policies, and accept compliance monitoring from the government.
Infosoft Solutions denies that it engaged in discriminatory hiring, according to the settlement filing. The company has not yet responded to a request for comment.
The settlement does not preclude individuals from filing cases accusing Infosoft of immigration-related discrimination, nor does it preclude the Justice Department Civil Rights Division’s Immigration and Employee Rights Section from investigating those allegations and filing related legal complaints.
“The Civil Rights Division will not tolerate national origin or citizenship status discrimination and is committed to knocking down these unlawful discriminatory barriers,” Assistant Attorney General Kristen Clarke said.
