Colorado GOP asks Supreme Court to overturn Trump’s ban from primary ballot

The Colorado Republican Party has formally asked the U.S. Supreme Court to overturn the decision to kick former President Donald Trump off the state’s presidential-primary ballot.

According to a report Wednesday evening on CNN, the appeal means the Colorado Supreme Court ruling will not take effect soon.

The state panel already had put a hold on its decision until Jan. 4, but the stay “will be indefinitely extended until the U.S. Supreme Court announces whether it will take up the appeal, and, if it does, until it issues a final decision in the matter.”

Mr. Trump has not personally appealed the decision yet, though his campaign said the day the decision was handed down that he would.

The state GOP does have standing as it was a party to the original decision as the conductor of the primary election on which the state high court was ruling.

The Colorado Supreme Court ruled Dec. 19 that Mr. Trump was ineligible to run for president in the state under the U.S. Constitution’s 14th Amendment because he participated in an “insurrection,” referring to the Jan. 6 U.S. Capitol riots.
